Terms of Use

The contents of this page and the documents within explain the terms of use to which you agree when using our app henceforth known as ‘the MannGo app.’ These terms apply whether you utilise the app as a guest or a registered user via your account. The use of this platform shall include any access and browsing along with use while registered or logged in to an account.

We advise that you read these Terms of Use closely prior to using the MannGo app as they will govern all use of these services. It would also be advisable to save them for future reference or print a copy.

By continuing to use the MannGo app you accept the following terms and agree to comply with them at all times. If you do not agree with these terms, then do not continue to use these services or contact us to discuss your concerns in order that we may assist as much as possible.

Disclaimer

The information on the MannGo app is intended to provide convenient information to our visitors and passengers who may use or are looking to use the demand responsive service, and to assist you with booking journeys and purchasing tickets. The products and pricing available are detailed at each stage of the booking process and are available for a selected range of journeys only subject to availability.

The Public Transport Division takes every reasonable effort to ensure that the information displayed on the website and the MannGo app is current, accurate and complete at all times, however this may be subject to change without notice and due to factors beyond our control. No representations or warranties are made (express or implied) in relation to the reliability, accuracy or completeness of any such information.

Availability of the MannGo App

While we endeavour to ensure that the app are available at all times, due to factors beyond our control there may be occasions upon which there are interruptions or loss of service. While this is regretful, we cannot accept any liability in the event of service unavailability.

Further, we may elect to suspend, withdraw, discontinue or change all or any section of the app without notice and cannot be held liable for any reason should these services be unavailable at any time or for any period.

The app is intended to serve people residing or visiting the Isle of Man and within the operational area of the service.

Revisions to these terms of use

We may at any time update these terms of use and will do so by updating the content of this page. We advise visiting this page periodically to review any such changes as they are binding in conjunction with the use of the MannGo app and services provided via these channels.

Modifications to the MannGo App

We reserve the right to make any necessary changes or corrections, amend, suspend or otherwise discontinue aspects of the app inclusive of the content and services available via these platforms at any time. Please be advised that although we will make every effort to keep the information on the app as current as possible, there may be occasions where it is out of date and we are under no obligation to ensure this is not the case.

Furthermore, any new feature, product, service or content offered via the app are subject to these terms of use unless otherwise stated.

Your account information

You should treat any and all information relating to accessing your account as confidential, whether this is chosen by yourself or assigned to you. It is your responsibility to handle sensitive information pertaining to your account and personal information therein carefully and not to disclose this to a third party.

We reserve the right to disable any login information relating to your account either chosen by yourself or allocated to you by us at any time in the event that it is brought to our attention you have failed to comply with any of these terms. This will result in you being unable to access our products and services moving forwards.

If you believe or are informed that a third party has gained access to any of your unique account information you should change your password as soon as possible and contact us for further advice.

Intellectual Property Rights

All intellectual property rights relating to the MannGo app and any content published within them are the property of the Department of Infrastructure. Such rights are protected under international copyright law and other applicable property rights and are reserved.

Use of the MannGo App

When purchasing services and using the payment method on the app it is your responsibility to ensure that you reach the legal age requirement for entering into such a contract in the operational jurisdiction.

In continuing to use the app you are confirming that you have the legal authority to enter into such terms of use including instructing us to collect payments from a credit or debit card from an authorised bank account or credit facility and to use the app in accordance with the full terms and conditions outlined. You also confirm that all information supplied by you when using the app is both true and accurate at all times. You will not use the app for any purpose beyond what is outlined in these Terms of Use and applicable law.

Viruses & Improper Use

Whilst we endeavour to provide safe and up to date information, no warranty is provided in terms of the app being free from errors, defects, viruses or any other form of malicious programs or macros.

It is your responsibility as the user to configure your technology and its associated platforms in order to access and use the app and we strongly advise the provision of virus protection software.

You are responsible for configuring your information technology, computer programs and associated required platforms when accessing the app.

In utilising the app and the services provided therein you agree that you will not:

  • Gain or attempt to gain access to content unauthorised, circumvent any security measures in place, or otherwise tamper with, hack into or disrupt the app in any way. This extends to the server on which these services are stored along with any other server, computer or associated device, database, router or any other internet enabled device connected to and used in conjunction with the app.
  • Misuse the app by knowingly introducing harmful components such as viruses, trojans, worms, logic bombs or any other such material with the potential to damage the app or disrupt the services provided; or purposely damage the app via the use of a denial-of-service attack or a distributed denial of service attack.

Breaching this provision constitutes a criminal offence under the Computer Misuse Act 1990 and the Department of Infrastructure will report any such breach to the relevant law enforcement body and co-operate with the authorities by disclosing any identifying information regarding the perpetrator to them. In the event of any of the above your right to access our app and associated services will cease immediately and without prior notice.

Other Terms

In the event that we fail to ensure you undertake your obligations in relation to these Terms of Use, or that we do not enforce our rights detailed within them against you this shall not result in us waiving said rights and does not mean that you are not obligated to comply. If the Department of Infrastructure ever do waive a breach by you this will be done only in writing and does not apply to any future default you may go on to commit.

If any clause within these terms become or are found to be illegal, unenforceable or otherwise invalid for any reason then the affected section will be removed from the Terms of Use and understood to be deleted and no longer applicable.

We reserve the right to alter these Terms of Use periodically and post the updated versions on the app and website. From the time of the updated Terms of Use being published all use of the app shall be subject to that version. It is the user’s responsibility to check these Terms of Use regularly as they are binding to the use of and provision of our services.
